2013 Terms and Conditions





    The following definitions shall apply within this document:
    ‘RSS' shall mean Read Sreet Sound and Video, its staff and representatives.
    'The Facilities' or 'Facilities' shall mean the physical operating location and equipment.
    ‘The Services’ or 'Services' shall mean any work provided by Read Street Sound and Video.
    ‘The Client’ shall mean the person(s), company or firm booking or using any service provided by Read Street Sound and Video.




        A request for work may be phoned to 443-921-0530, or emailed to RSS at: "billing@readstreetsound.com". "RSS"' may then confirm the booking. "RSS" shall not be liable for the consequences of any changed, erroneous, incorrect, lost, failed or inaccurate information conveyed by "The Client" or understood by "RSS".

        Credit Status and Terms agreements will only be made after requested in writing. If credit Terms are granted, settlement will be required within 30 days of invoice date. The Credit and Terms arrangement may be withdrawn if payments are regularly received late. Should the balance of the account reach any credit limit offered, further booking of "The Facilities" may be refused, and all amounts due will be payable immediately.

        In the event that these terms are exceeded and payment is not forthcoming, "RSS" reserves the right to suspend availability of "The Facilities" and place the account in the hands of collection agents for recovery of the sums involved, together with any costs and interest incurred by such action. "RSS" reserves the right to retain any and all material in its possession against failure to make payment of its invoices.

        If credit arrangements have not been made, all charges will be required at the end of the session. Otherwise, edit masters, media used and/or graphics rolls and/or duplication will be retained until settlement is received. Edit masters and/or graphics rolls and/or duplication may also be retained while a check is being cleared.

        A standard day is regarded as a continuous period of 10 hours, generall commencing at 9:00 AM and completing at 5 PM, unless otherwise agreed priot to work. The minimum booking is 2 hours at RSS standard Radecard amounts, or 4 hours on site and all bookings are charged in ½ hour increments. Additional time may be charged at agreed upon rates. For non-continuous periods of booking, amounts owed will be immdiately payable until bookings resume. Duplication, dubs, copies etc are charged separately from and outside of record/editing/graphics time.

        "RSS" reserves the right to charge a cancellation fee if cancellations are made later than 48 hours from the start time of the booking. Bookings cancelled within 48hrs will be subject to a charge of 25% of the total booking value. Bookings cancelled within 24hrs will be subject to a charge of 50% of the total booking value.

        Any dispute relating to an invoice or to work completed must be raised within 10 days of date of the invoice, however non disputed charges are immediately payable during the suspense period.

        Tapes, Media, and other goods while on the premises are to be insured by "The Client". "The Client" uses unique or original material at his entire risk. "RSS" will not under any circumstances accept liability for any loss or damage to this material. If "RSS" is requested to send tapes or goods by courier or by post on behalf of "The Client", responsibility for their safety rests with "The Client" at all times.

        "RSS" shall own any material shot, recorded or created, or fabricated and may re-sell and license at it's discretion any original footage, herein known as "B-Roll", unless any Copyright or license prevails. "RSS" is always granted the right to display any created material as samples of it's work.

        "The Client" shall indemnify "RSS" against any losses or expenses arising from any claim by a third party or breach of copyright or defamation relating to any work carried out for "The Client" by "RSS". "RSS" may refuse to carry out work on what appears to be copyrighted or otherwise similarly protected material.

        "The Client" shall remove all of his materials from the premises of "RSS" within 3 months of the date of the most recent invoice relating to work on these materials, unless agreed in writing by The "RSS". Thereafter the said materials shall become the property of "RSS" who shall dispose of them.

        Rates are subject to change without notice, and all prices are subject to tax at the current rate.

        "RSS" reserves the right to use their discretion with respect to variance of any or all of the above conditions.
